What is a Section 22 Agreement?
A Section 22 Agreement refers to an agreement under Section 22 of the Children’s Act 38 of 2005, which allows a parent or legal guardian to confer specific parental responsibilities and rights to another person.
A parent or legal guardian can enter into a written, formal agreement with another person, such as a grandparent, stepparent, or family member if they believe it is in the child’s best interests. To be legally valid, the agreement must be registered with the Family Advocate or confirmed by the court.
